Terms of Service

You must be at least 18 years old to create an account or place an order. By using the Site, you represent that you meet this requirement and that the information you provide is accurate.

You can create an account using a magic link sent to your email or by connecting your Discord account. You're responsible for keeping your email and Discord credentials secure. We're not liable for activity on your account that results from compromised credentials you control.

Member-only features (tournaments, posts, members directory, live events, member-exclusive deals) require Discord login and membership in our Discord server.

When using the Site, you agree not to:

• Scrape, crawl, or extract data in bulk without our written permission.
• Reverse-engineer or attempt to gain unauthorized access to any part of the Site.
• Use the Site to commit fraud, infringe on others' rights, or violate any law.
• Post content that is unlawful, abusive, defamatory, or infringes intellectual property.
• Impersonate another person or misrepresent your affiliation with anyone.
• Interfere with the operation of the Site (DDoS attempts, malware, etc.).

We may suspend or terminate accounts that violate these rules, with or without notice.

Prices are listed in U.S. Dollars and may change without notice. When you place an order, you authorize us to charge your selected payment method via Stripe for the listed price plus any applicable taxes and shipping. Payment processing is handled by Stripe; we never store your full card details on our servers.

We reserve the right to refuse or cancel any order, including for product or pricing errors, suspected fraud, or limits on quantities. If we cancel after payment, you'll receive a full refund.

Sales tax is calculated at checkout where applicable.

We're a small operation that hand-ships every order. We'll confirm shipping timing and tracking after your order is placed.

We're still finalizing our written returns & refund policy. Until that's published, returns are handled on a case-by-case basis: if something arrives damaged, defective, or wasn't what you ordered, contact us at tbg@mysimsetup.com within a reasonable time of receipt and we'll work it out with you. Some products are subject to manufacturer return policies and restocking fees that we'll communicate before any return is authorized.

Some links on the Site (especially in our Gear & Deals section) are affiliate links. When you click through and purchase from a third-party retailer, we may earn a commission at no additional cost to you. We only recommend products we actually use or have vetted, and the commission doesn't change our editorial opinion or rankings.

If you post content (sim setups, posts, comments) you keep ownership of it. By posting, you grant us a non-exclusive, royalty-free license to host, display, and distribute that content on the Site and in promotional materials about the Site (e.g., social media posts about our community).

You're responsible for ensuring your content doesn't infringe on third-party rights or violate these Terms.

All Site code, design, logos, graphics, and text (other than User Content) are owned by My Sim Setup, LLC or our licensors and are protected by U.S. and international copyright and trademark laws. You may not reproduce, modify, or distribute them without our written permission.

The Site relies on third-party services including Stripe (payments), Resend (email), Vercel (hosting), Upstash (data storage), Discord (authentication and community), and various affiliate partners. Their terms apply to their portions of the experience and we are not responsible for their actions or outages.

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Reviews, comparisons, and product recommendations on the Site reflect our opinions based on personal use and research. They are not professional advice. Always do your own due diligence before purchasing expensive equipment.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY SIM SETUP, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE.

Our total liability for any claim arising out of or relating to these Terms or the Site will not exceed the greater of $100 USD or the amount you paid us in the twelve months preceding the claim.

You agree to indemnify and hold My Sim Setup, LLC harmless from any claims, losses, or damages (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

We may suspend or terminate your access at any time for violations of these Terms or for any other reason at our discretion. You may close your account at any time by contacting us.

Sections that by their nature should survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Disputes) will continue in effect.

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules.

Before filing any formal claim, you agree to first contact us at tbg@mysimsetup.com and attempt to resolve the dispute informally for at least 30 days.

If the dispute cannot be resolved informally, you and My Sim Setup, LLC agree that any claim must be brought in a state or federal court located in Colorado, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent change. For material changes, we'll provide notice (e.g., a banner on the Site or an email if we have your address). Continued use after changes means you accept the updated Terms.
